Aprobada región Metropolitana Bogotá-Cundinamarca en sesiones extraordinarias
El pleno de la Corporación aprobó con 64 votos por el sí y 22 por no el informe de ponencia, al considerar las modificaciones expuestas presentadas con ponencia positiva, tras solicitar a los senadores, dar segundo debate al proyecto de ley 152/2021 Senado-213/2021 Cámara por medio de la cual se modifica el artículo 325 de la Constitución Política y se expide el régimen especial de la Región Metropolitana Bogotá-Cundinamarca.
Al respecto de los reparos expresados por sus homólogos durante la deliberación del proyecto, el senador ponente, Germán Varón Cotrino (Cambio Radical) aclaró que desde luego existirá una articulación con la Corporación Autónoma Regional para el manejo de los temas ambientales. Así mismo, señaló que la sentencia T-348 de la Corte Constitucional del 2021 estableció que la totalidad del Acto Legislativo es constitucional e incluso negó la posibilidad de hacer una consulta popular dado que no se viola ningún derecho. Finalmente, concluye su intervención sugiriendo la votación del artículo 43 por separado para dar un debate más amplio sobre este tema.
La sesión avanzó con la votación del primer bloque de artículos, los cuales no contaban con proposición (46 artículos) siendo aprobados con un resultado de 70 por el sí y 21 por el no.
El segundo bloque aprobado fue de 11 artículos con proposición para los cuales el senador ponente sugirió que fuesen negados dado que, pese a las buenas intenciones, luego de ser revisados desde un punto de vista técnico, no son convenientes. Como resultado, las proposiciones para este bloque de artículos fueron negadas con 64 votos por el sí y 12 por el no.
Por otro lado, el senador John Milton Rodríguez (Partido Colombia Justa Libres) solicitó la reapertura de tres artículos (39, 40 y 41) que incrementan los impuestos y considera nocivos para los habitantes de Cundinamarca.
Finalmente, la plenaria del Senado aprobó con 59 votos por el sí y 12 por el no el bloque del articulado, el título y la pregunta de la voluntad del cuerpo legislador para convertir en ley de la República esta iniciativa.
El ministro del interior, Daniel Palacios, agradeció el respaldo del Congreso de la República al nacimiento de la Región Metropolitana, quien finalizó su intervención con la siguiente declaración: “hoy con este mensaje estamos diciendo que esa verdadera integración entre Cundinamarca y Bogotá es una realidad”.
